An employee who uses medicinal marijuana has a reasonable expectation of privacy in their use of the drug, and there is no general law in Ontario that requires an employee to disclose the use of medical cannabis to their employer. An employee may also not want their employer to know about a sensitive medical condition they have. The protection of personal information in this respect is important. Indeed, workplace policies that automatically discipline employees for not coming forward and disclosing disability-related cannabis use or cannabis addiction may be discriminatory. However, there are exceptions and instances in which disclosure of your medicinal cannabis use to your employer is required by law.
